Cerimónia de tomada de posse da notária privada Dra. Mok I Leng

Ocorreu no dia 12 de Dezembro de 2019, a cerimónia de tomada de posse dos notários privados em Macau, dos quais, a Dra. Mok I Leng foi uma das advogadas nomeadas pela Direcção dos Serviços de Assuntos de Justiça de Macau como notária privada, tornando possível exercer actividades notariais na Região Administrativa Especial de Macau. Consequentemente, foi prestado na mesma cerimónia, o juramento de compromisso de honra, tendo prestado juramento do bom exercício da sua função como notária privada e que irá elevar a qualidade e a eficiência dos serviços notariais.

澳門私人公證員的就職典禮於2019年12月12日舉行，其中莫綺玲為獲法務局委任為私人公證員的律師之一，透過該委任獲賦予權限在澳門特別行政區從事各類公證行為，並在典禮上宣誓就職，將適當行使其作為私人公證員的權力，以提升公證服務的質量和效率。

公信國際仲裁（澳門）協會之就職典禮於2019年11月8日舉行。在來自澳門、香港和中國內地各個界別的專業人士的共同見證下，公信國際仲裁（澳門）協會理事會主席莫綺玲女士闡述建立此協會的理念，透過雙邊及多邊的交流合作，促進澳門特區國際仲裁和調解的專業發展，並與世界各地推動國際仲裁與調解的研究，相互借鑒，共同發展。協會將透過籌辦或參與符合設會宗旨的多類型論壇、研討會、講座及出版文章等，向大眾推廣澳門、香港、中國內地及東盟國家的仲裁和相關法律制度。鞏固澳門作為亞太區重要文化傳統下之國際仲裁中心地位，同時推動澳門成為粵港澳大灣區及解決中葡經貿爭議的仲裁中心。

Inauguration Ceremony of the Public Trust International Arbitration Association (Macau)

The inauguration ceremony of the Public Trust Internacional Arbitration Association (Macau) took place on the 8^th of November 2019. In the presence of professionals from various areas such as Macau, Hong Kong, and Mainland China, where the President of The Association, Ms. Mok I Leng, addressed the purpose for creating the respective Association and through the said Association to promote international arbitration and mediation in the Macao SAR by bilateral and multilateral exchange and collaboration, as well as, aims to facilitate the study of arbitration and mediation for the betterment of the society. The AAICPM will organize and participate in various forums, conferences and lectures as well as publish several up-to-date articles on the topic on arbitration and mediation in order to promote arbitration, mediation and the relevant regulations in this field to the general public of Macao, Hong Kong, Mainland China, and ASEAN countries. The Association also aims to consolidate as an important international arbitration center under the rich cultural background that affects the asia-pacific region as well as to strengthen Macao’s position as a preferred international arbitration and mediation center in the Asia-Pacific region for Sino-Portuguese conflicts in the Greater Bay Area, due to its’ relevant cultural background.

Cerimónia de Inauguração da Associação de Arbitragem Internacional Confiança Pública de Macau

A cerimónia de inauguração da Associação de Arbitragem Internacional Confiança Pública de Macau ocorreu no dia 8 de Novembro de 2019. Estiveram, presentes, profissionais de várias áreas oriundos de Macau, Hong Kong e da China Continental, tendo, a Presidente da Associação, Dra. Mok I Leng, discursado sobre o seu objectivo na criação da Associação, a qual consiste numa organização sem fins lucrativos com o objectivo de promover a arbitragem e medição internacional na Região Administrativa Especial de Macau, através do intercâmbio e colaboração bilaterais e multilaterais. A principal finalidade é de facilitar o estudo de arbitragem e mediação. A AAICPM organizará e participará em vários fóruns, conferências e palestras, bem como, publicará vários artigos actualizados quanto aos tópicos de arbitragem e mediação, a fim de promover a arbitragem, a mediação e as respectivas regulamentações ao público em geral de Macau, Hong Kong, China Continental e dos países da ASEAN. A Associação também visa não só em consolidar Macau como um centro internacional de arbitragem pelo seu rico panorama cultural perante a região ásia-pacífica, mas também, em fortalecer a posição de Macau como sendo um centro internacional de arbitragem e mediação de preferência na região Ásia-Pacífico para os conflitos sino-portugueses na Grande Baía.

Esther Li, advogada estagiária em Macau e vice-presidente e secretária-geral da dita Associação, reuniram em Zhuhai no dia 10 de Abril de 2019, entre outros, com o Dr. Liu Wenwu, Dr. Han Haidong, Dr. Liang Wenda, Dr. Li Lihua e Dr. Huang Kaixin, Dr. Qiu Song, Dr. Shi Fu e o Dr. Chen Hongcun

A Dra. Mok I Leng (advogada em Macau e Presidente da Direcção da Associação de Arbitragem Internacional Confiança Pública (Macau) – AAICPM) e a Dra. Esther Li, advogada estagiária em Macau e vice-presidente e secretária-geral da dita Associação, reuniram em Zhuhai no dia 10 de Abril de 2019, entre outros, com o Dr. Liu Wenwu (advogado e secretário da Yingke Law Firm em Zhuhai), Dr. Han Haidong (presidente da direcção de Associação de Arbitragem de Guangzhou em Zhongshan), Dr. Liang Wenda (vice-presidente da mesma Associação), Dr. Li Lihua e Dr. Huang Kaixin (secretários da dita Associação ), Dr. Qiu Song (advogado e director das finanças e membro da comissão de benefícios da Associação de Advogados de Zhuhai) Dr. Shi Fu (advogado e secretário da Beijing Zhongyin Law Firm (Zhuhai) e o Dr. Chen Hongcun (advogado) (“Participantes”).

Foi considerado pelos Participantes que a referida Associação de Arbitragem de Guangzhou em Zhongshan é a única entidade de arbitragem em matéria cível e comercial em Guangzhou, e que resolve, com elevados padrões de qualidade, conflitos de natureza cível e comercial surgidos entre particulares. Foi ainda considerada pelos Participantes a situação de arbitragem em Zhongshan, entre outros aspectos, o tempo habitualmente necessário para a resolução de um caso, e os critérios para determinação das custas do processo.

Foi ainda considerado pelo Grupo de Trabalho o estádio e nível de desenvolvimento da arbitragem e mediação em Macau e Hong Kong.

Quanto a Macau, foi considerado que desempenha, hoje em dia, um papel de relevo na promoção e desenvolvimento da Área da Grande Baía (Macau – Hong Kong – Zhuhai) e que é expectável um aumento acrescido do nível de cooperação institucional não só a nível privado como também a nível público relativamente às três regiões.

Quanto à vizinha região de Hong Kong, considerou-se ainda a “Apology Ordinance” (Lei da Desculpa) constando do Capítulo 631 das Leis de Hong Kong, visando promover e encorajar a apresentação de pedidos de desculpa em vista a evitar a escalada de litígios e facilitar a sua resolução amigável. Foi aí considerado também que o desenvolvimento dessa matéria é diferente no Interior da China e em Macau.

O intercâmbio de informações entre os Participantes foi um grande sucesso e um óptimo começo de relações com instituições congéneres da AAICPM, a qual contribuirá assim nos termos dos seus estatutos, para a dinamização do estudo, entendimento e cooperação entre instituições e profissionais do foro das três regiões.

A encerrar o encontro dos Participantes, a Sra. Dra. Mok I Leng manifestou ainda ter ficado bastante satisfeita com o sucesso do encontro e discussão havida, tendo ainda tomado a oportunidade dado as boas vindas aos referidos Dr. Han Haidong e o Dr. Liu Wenwu, que passaram a integrar a equipa de assessores da AAICPM.

Madam Mok I Leng (Macau lawyer and President of the Board of the “Public Trust International Arbitration Association (Macao)” – PTIAA) and Ms. Esther Li, trainee lawyer in Macau and Vice-President and Secretary-General of the said Association, met as part of a work group in Zhuhai on April 10^th 2019, among others, with Dr. Liu Wenwu (lawyer and secretary of Yingke Law Firm in Zhuhai), Dr. Han Haidong (President of Zhongshan Sub-Commission of China Guangzhou Arbitration Commission), Dr. Li Lihua and Dr. Huang Kaixin (secretaries of the said Commission), Dr. Qiu Song (lawyer and Finance Director and a member of the benefits commission of the Zhuhai Lawyers Association), Dr. Shi Fu (lawyer and secretary of Beijing Zhongyin Law Firm (Zhuhai) and Dr. Chen Hongcun (lawyer) (“Participants”).

It was considered by the Participants that the said Guangzhou Arbitration Commission in Zhongshan is the sole arbitration entity, and which resolves, disputes of civil and commercial nature arisen among private entities. It was also considered by the Participants, the status quo of arbitration in Zhongshan, among other aspects, the time duration usually needed for the resolution of a given case, and the criteria for the determination of the costs with a case.

It was also considered by the Participants, the stage and development pace of arbitration and mediation in Macau and Hong Kong.

As for Macau, it was considered that nowadays, it performs a relevant role within the promotion and development of the Great Bay Area (Macau – Hong Kong – Zhuhai) and that it is expected to see an added increase to the level of institutional cooperation not only at the private sector level but also at the public-sector level, regarding the three regions.

As for the neighbouring region of Hong Kong, it was also considered the “Apology Ordinance” provided in Chapter 631 of the Laws of Hong Kong, aiming at promoting and encouraging to present apologies in turn aiming at avoiding the escalation of disputes and thus facilitating an amicable resolution. It was therein also considered that the development status regarding this matter is different in Mainland China and in Macau.

The exchange of information between the Participants was a great success and a great start of relations with PTIAA with similar institutions, which will thus contribute pursuant to its Articles, towards the increase of study, understanding and cooperation between institutions and professionals from the three regions in the field of arbitration.

Upon closing the meeting of the Participants, Madam Mok I Leng also expressed having been quite pleased with the success of the meeting held and discussion had, having also taken the opportunity to welcome the said Dr. Han Haidong and Dr. Liu Wenwu, who became consultants of PTIAA.

設立於澳門的「公信國際仲裁(澳門)協會」，理事會主席莫綺玲大律師會同該會黎道茵副主席兼秘書長及其他隨員於二零一九年四月十日前往珠海和劉文武、韓海東、梁聞達、李麗華、黃凱欣，丘松，石賦及陳洪川等好友會面，在共進午餐的輕鬆愉快氣氛下相談甚歡，彼此有很好的交流。

設立於澳門的「公信國際仲裁(澳門)協會」，理事會主席莫綺玲大律師會同該會黎道茵副主席兼秘書長及其他隨員於2019年4月10日前往珠海，和盈科珠海分所黨支部書記劉文武律師、廣州仲裁委員會中山分會韓海東會長、梁聞達副會長、李麗華秘書、黃凱欣秘書，珠海市律師協會財務指導監督和福利工作委員會丘松律師，北京市中銀（珠海）律師事務所黨支部書記石賦律師及陳洪川律師等好友會面，在共進午餐的輕鬆愉快氣氛下相談甚歡，彼此有很好的交流。中國廣州仲裁委員會作為廣州地區唯一的民商事仲裁機構，能高效地解決眾多民商事合同糾紛及其他財產權益糾紛。

透過是次會談我方瞭解現時中山仲裁案的進行、收費標準及結案速度等情況，席中談及港澳仲裁和調解方面的進展，並討論關於香港於2017年根據香港法例第631章所生效的”道歉條例”，目的是促使對道歉的一方，避免在日後如有訴訟上構成任何不利因素時，道歉亦不致使保險失效，但此方面的進展跟國內及澳門有所不同。各方均認同採用仲裁和調解解決紛爭，成效十分高。

澳門時至今日在灣區定位與發展方向已十分明確，因此，祈望日後能展開更多的合作機會、為三地促進交流、學習機會及分享經驗，以期帶動粵港澳大灣區的仲裁和調解的發展，共創緊扣灣區的共同目標。

最後，「公信國際仲裁(澳門)協會」理事會主席莫綺玲大律師亦十分高興能成功地邀請廣州仲裁委員會中山分會韓海東會長和珠海跟盈科珠海分所黨支部書記劉文武律師為該會的顧問團隊成員之一，日後能與其他澳門及香港知名及經驗豐富的仲裁專家顧問一併發展和支持該會的會務宗旨。是次交流十分成功，為未來的粵港澳合作建立了良好的開端。
